Data we collect

Identity data (name), contact data (email and phone), company details, order and invoice data, and technical data such as IP address and cookies. We do not store your card details; payments are processed directly by the licensed payment institution iyzico.

Purposes of processing

Providing our services and performing contracts, invoicing, responding to your requests, meeting legal obligations, keeping the website secure and improving our services.

Legal basis

We process your data under Article 5 of KVKK: necessity for concluding and performing a contract, legal obligation, legitimate interest, and your explicit consent where required.

Data sharing

We may share your data with the payment institution iyzico to complete payments, with hosting and accounting providers, and with public authorities where legally required. We never sell your data.

Retention

We keep data for as long as necessary for the purposes above or as required by law, after which it is deleted or anonymised.

Your rights

Under Article 11 of KVKK you may learn whether your data is processed, request information, ask for correction or deletion, object to processing and claim compensation for damages. Send requests to [email protected].

Cookies & security

We use cookies that are essential for the site and analytics cookies you can disable in your browser. All connections to the site are encrypted with an SSL certificate.

Scope

These conditions cover software development, landing pages, content management, digital marketing and AI solutions ordered through the website or a written proposal.

Delivery method

Services are delivered electronically: by email, access links, code repository or deployment to the client’s servers, depending on the service.

Delivery time

Delivery time is stated in the proposal or order summary and starts once the advance payment and required materials are received. Performance starts within 30 days unless otherwise agreed.

Acceptance & review

The client reviews the delivery within 7 business days and may request the revisions included in the scope. Delivery is deemed accepted if no feedback is received within this period.

Cancellation before work starts

The client may cancel the order before work starts and receive a full refund.

Cancellation after work starts

If work has started with the client’s approval, only the amount for the unperformed part is refunded. Services custom-made to the client’s specifications are excluded from the right of withdrawal under Article 15 of the Distance Contracts Regulation.

Monthly services

Content and marketing subscriptions can be cancelled with 30 days’ notice; the month already in progress is not refunded.

Refund method

Refunds are made to the original payment method via iyzico within 14 days of approval; the time to appear on your statement may vary by bank.

Article 1 — Parties

Seller: Five Pathways Yazılım ve Bilişim Limited Şirketi, address: Başakşehir Mah. Olimpiyat Blv. Medikule F2 Blok No: 2A İç Kapı No: 89, Başakşehir / İstanbul, tax office: Başakşehir, tax no: 3871455317, email: [email protected]. Buyer: the person whose details are entered when placing the order.

Article 2 — Subject

This contract sets out the rights and obligations of the parties regarding the sale and performance of the digital services the buyer orders electronically on the website.

Article 3 — Service details

The type, scope, duration, price and payment terms of the service are stated in the order summary or approved proposal, which form an integral part of this contract.

Article 4 — Price & payment

Prices include VAT unless stated otherwise. Payment is made by credit or debit card (Visa and Mastercard) through the secure iyzico payment gateway with 3D Secure verification.

Article 5 — Performance & delivery

The service is performed and delivered electronically within the period stated in the order, not exceeding 30 days from the contract date unless otherwise agreed.

Article 6 — Right of withdrawal

The buyer may withdraw within 14 days of the contract date without giving reasons by notifying [email protected]. This right does not apply to services whose performance has started with the buyer’s approval before the period ends, or to services custom-made to the buyer’s request (Article 15 of the Regulation).

Article 7 — Refunds

If the right of withdrawal is exercised, payments are refunded within 14 days to the original payment method, in line with the Delivery and Return Conditions published on the website.

Article 8 — Disputes

The buyer may apply to Consumer Arbitration Committees or Consumer Courts within the monetary limits set annually by the Ministry of Trade. Istanbul courts and enforcement offices have jurisdiction over other disputes.

Article 9 — Effect

The buyer is deemed to have read and accepted this contract electronically upon confirming the order and completing payment.
